Please read these Terms of Service carefully before utilizing DupliClip. By accessing our studio, uploading media, or purchasing credits, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and DupliClip ("Company", "we", "us", or "DupliClip.ai") governing your access to and use of the dupliclip.com website, APIs, AI video generation engines, and related services (collectively, the "Service").
If you do not agree to these Terms, you must immediately discontinue use of the Service.
2. Eligibility & Account Security
You must be at least 13 years old (or the legal age of digital consent in your jurisdiction, e.g., 16 in certain EU member states) to use DupliClip. If you are under the age of majority, you may only use the Service with the consent and supervision of a parent or legal guardian.
You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. Notify us immediately at support@dupliclip.com if you suspect any unauthorized use of your account.
3. Acceptable Use Policy & Prohibitions
DupliClip provides powerful AI portrait video synthesis. With this capability comes strict responsibility. You explicitly agree that you will NOT:
- Unauthorized Likeness: Upload photos of individuals without their explicit authorization or consent, or create non-consensual deepfakes of private individuals or public figures.
- Sexually Explicit & Harmful Content: Generate pornographic, non-consensual intimate imagery (NCII), child sexual abuse material (CSAM), or sexually suggestive content involving minors.
- Harassment & Hate Speech: Use the Service to defame, harass, bully, threaten, or promote violence against any individual or protected group.
- Deceptive Misinformation: Generate deceptive political deepfakes, financial scams, or fraudulent impersonations intended to deceive viewers.
- System Exploitation: Reverse engineer our software, overload our GPU clusters with automated scripts, bypass credit metering, or deploy unauthorized crawlers.
Violation of these acceptable use terms will result in immediate termination of your account, forfeiture of remaining credits, and potential referral to law enforcement authorities.
4. Credits, Billing & Subscriptions
DupliClip operates using a virtual credit economy to allocate high-performance cloud GPU rendering:
- Credit Deduction: Every video generation job estimates and reserves a set amount of credits based on template duration and model complexity. Credits are finalized only upon successful video delivery.
- Failed Generations: If an AI video job fails due to server errors or timeout, reserved credits are automatically unlocked and returned to your balance.
- Subscription Billing: Monthly subscription tiers automatically renew at the beginning of each billing cycle. You can cancel your subscription at any time via your account settings or Stripe Customer Portal.
- Non-Transferable: Credits have no cash value and cannot be transferred, resold, or redeemed for fiat currency.
5. Intellectual Property & Commercial License
Your Source Media: You retain full ownership and intellectual property rights in the original photos you upload. You grant DupliClip a limited, non-exclusive license solely to process and render the requested videos.
Commercial Rights to Generated Videos: As a paying user of DupliClip, you own the resulting video files synthesized from your inputs and are granted full worldwide commercial rights to publish, monetize, and distribute the videos across social platforms (TikTok, Instagram Reels, YouTube Shorts, advertising campaigns). You remain responsible for ensuring your source content does not infringe third-party copyrights or trademarks.
Platform IP: DupliClip and its licensors retain all rights, title, and interest in and to the platform, motion synthesis pipelines, website design, trademarks, and logos.
6. Disclaimers & AI Generation Limitations
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AI video generation technology is probabilistic and experimental. While we strive for photo-realism and consistency, we do not guarantee that generated videos will be entirely artifact-free or meet specific subjective aesthetic expectations on every attempt.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DUPLICLIP, ITS AFFILIATES, OFFICERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO DUPLICLIP IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
8. Termination & Suspension
We reserve the right to suspend or terminate your account immediately if you breach these Terms or engage in fraudulent, harmful, or unauthorized activities. You may terminate your account at any time by ceasing use of the platform and contacting support.
